Jehmuel James

President & CEO

Thank you for choosing Microfidelity!

This Privacy Policy details our practices for minimizing and protecting the data we collect. We encourage you to read the entire Policy. However, to save your valuable time, you can use the links below to go directly to the sections that pertain to the services you use, as our data handling practices differ depending on the service.

If you have questions about our practices or any of your rights described below, you may contact us at privacypolicy@microfidelity.uk. This inbox is actively monitored and managed so that we can deliver an experience you can trust.

01. About Us, Our Offerings, and Our Site

1.1 Microfidelity provides a variety of offerings to clients ("you"), which include hosting and web services (such as shared, VPS, dedicated hosting, WordPress hosting, website builder, and email hosting ("Hosting Services")), cloud solutions (including FidelityCloud) ("Cloud Services"), and domain registration services ("Domain Registration Services"), among others.

1.2 The offerings provided by Microfidelity are collectively referred to as the Services in this Notice.

1.3 We also maintain a website (the "Website") where visitors, prospective clients, and potential job applicants can learn more about us and our Services.

02. Hosting and Cloud Solutions

This section details our privacy practices related to the data we collect while providing Hosting and Cloud Services to you.

In this context, "client" refers to businesses to which we provide Hosting and Cloud Services.

2.1 Information We Collect During the Provision of Hosting and Cloud Services

2.1.1 When clients utilize our Hosting and Cloud Services, they provide us with data related to third parties. We collect this data strictly according to our clients' instructions, meaning that our clients control the data uploaded to our platforms.

2.1.2 We establish agreements with our clients outlining our legal responsibilities regarding the data, clarifying that we may use this data only to provide the Services to our clients (i.e., Hosting Services, Cloud Services, or Domain Registration Services). In numerous jurisdictions, especially within the European Economic Area (EEA), Microfidelity is regarded as a "data processor" in relation to such client data. Each of our clients is considered a "data controller." As a controller, each Microfidelity client is responsible for meeting the GDPR requirements for controllers, which includes notice, disclosure, and specific legal bases for transferring data to Microfidelity and using the Hosting and Cloud Services. As a processor, Microfidelity has some, but not all, of those responsibilities.

2.1.3 For more information about the data collected by a specific Microfidelity client and subsequently transferred to Microfidelity, please refer to that client's privacy notice, typically found on their website.

2.1.4 There are instances where we act as a data controller. The remainder of this Privacy Policy explains our data collection practices in those situations.

2.2 Information Provided by You

2.2.1 The personal data we gather from you varies based on the type of service or support you need.

2.2.2 Some personal information is directly collected from you when you:

(a) Create an account or purchase any of our Services (e.g., billing details, contact info, credit card number, and in some cases, government identification);

(b) Request help from our technical support team (e.g., your phone number or email address);

(c) Log in to your account, such as your login credentials (e.g., your username and password);

(d) Fill out contact forms or request newsletters or other information from us (e.g., your email address); or

(e) Participate in surveys, contests, or activities we promote that might require your information.

2.2.3 We also gather and process other data that may not be as obvious to you. For example, account-related information is collected in connection with your use of the Services (such as the types of services you've used, your payment history, payment amounts, your domain name, information about when products renew or expire, customer service requests, information requests, etc.).

2.2.4 Some of this data may be personal data. We might use this information to contact you occasionally about our products, promotions, and other services that relate to your account. You can manage and select the information you wish to receive. Please see Section 11 for more details.

2.2.5 Most of the personal information we collect is essential to keep our Services functional and accessible to you. If we ask for personal information beyond this scope, we'll clearly explain why we need it (and what the effects of not providing it may be).

2.3 Information We Collect Automatically

2.3.1 When you use our Hosting Services, we might automatically collect specific information from your device. This may include details such as your IP address, device type, unique device identification numbers, browser types, information about your broad geographic location (e.g., country or city level location), and other technical information that may identify you.

2.3.2 For instance, data about service usage is automatically collected when you use and interact with our Services, including metadata, log files, and cookie/device IDs. This data includes specific information about your interactions with the features, content, and links (including those of third parties, such as social media plugins) within the Services, as well as the information listed above.

2.4 Information We Collect from Third-Party Sources

2.4.1 As a data controller, we might collect information from third parties. This can include details from partners to maintain your Services' functionality (such as domain name registrations and third-party email suites). We may combine this data with information we already have to properly update, analyze, and expand our Services. This information will only be used for the specific reason it was provided to us.

03. Data We Collect When You Visit or Use Our Site

3.1.1 Information you provide

These ads appear as product banners during your browsing sessions. We collaborate with third-party partners to manage advertising across our website and other platforms. 6. Legal Basis for Processing Personal Information

6.1 The legal basis for collecting and using personal information depends on the specific context in which we collect it. Typically, we collect personal information with your consent, to fulfill contractual obligations, or where processing serves our legitimate interests without overriding your rights and freedoms. In some cases, we may have a legal obligation to collect personal information.

6.2 When we request personal information to comply with legal requirements or to perform a contract, we will inform you whether providing such information is mandatory and the potential consequences of not providing it. Similarly, if we rely on legitimate interests to process your data, we will explain those interests at the relevant time.

07. Entities with Whom We Share Your Information

Legal Compliance

7.5 Microfidelity operates primarily in California, USA, and adheres to local laws and regulations. We may cooperate with law enforcement agencies in ongoing investigations, including secure data handover as legally required.

We implement suitable technical and organizational measures to safeguard the personal data we collect and process about you. These measures are designed to ensure a security level appropriate to the risk associated with processing your personal data. For instance, we minimize log retention to the necessary minimum required for our systems administration and security staff to monitor service functionality effectively.

11. Data Processing in the United States

11.1 Your personal data might be processed in countries other than your country of residence. These countries might have data protection laws that differ from those in your country and may not be as protective. Specifically, our Website servers are based in the United States. Consequently, when we collect your personal information, we typically process it in the United States. We have put in place appropriate safeguards to ensure that your personal information remains protected according to this Privacy Policy.

12. Data Retention and Deletion

We retain personal data we collect from you as long as there is an ongoing legitimate business need (e.g., compliance with legal, tax, or accounting requirements, enforcement of our agreements, or fulfillment of our legal obligations). When there is no ongoing legitimate business need to process your personal data, we will either delete or anonymize it. If deletion is not possible (e.g., because your data is stored in backup archives), we will securely store your personal information and isolate it from further processing until deletion becomes feasible.
